The pre-trial conference nominally scheduled for Monday finally took place this morning.  Mr. Wilson was present with his attorney.  I forget her name but she was representing a number of other clients that morning and my impression was that she is with the public defender&#039;s office.  The proceedings didn&#039;t take a lot of time.  Basically, two things got done.

First, the prosecution submitted evidence for review by the defense and the court.  This is evidence from a search consented to by the defendant, search pursuant to a warrant, and statements of the defendant.  The defense and the court now have ten days to review the evidence, and challenge anything they think should be ruled inadmissable, and, I guess, to submit any evidence they wish.

This evidence was not discussed.  It is in written form.  The submittal starts the ten-day clock.

Second, a date was finally set for the trial.  That is Monday, April 30.  Backup dates were also set: Monday, May 21, and Monday, June 11.

Far as I can tell, the way this scheduling works is that a number of cases are placed on the docket for the week of the nominal date, and the court gets to them that week if cases ahead of them in the lineup are concluded.  If the week ends without a scheduled case being tried, it goes to the week of the next backup date.  This is how the system deals with the inevitable uncertainty regarding how much time any case will take.]]></description>

		<description><![CDATA[I was very saddened to read about this story after seeing a post on Facebook; one of my friends posted the billboard that is up in N.C.  I live in Norman, OK.  I was struck in May of 2009 which effectively ended my cycling/multisport/running careers.  I am, however, very fortunate to be alive.  Again, I am so very sorry that Adam&#039;s family and friends are having to deal with his loss---so very very sorry.]]></description>

		<description><![CDATA[I checked with the Cabarrus Clerk of Court’s office this past week for an update on Stacy Renee Shaw, and also Daniel Burton Wilson, who head-oned six cyclists. I was told that Wilson was arraigned last summer, but his case is still pending: he still has not come to trial.
 
On the larceny charge, Stacy got community service and an order to pay restitution. I was told this was a theft of cash. She had done the community service but still had not paid the restitution.
 
The lady at the Clerk’s office also said Stacy got caught driving again, on suspended/revoked license. She didn’t have further specifics on that at her fingertips, but said that combined with the larceny conviction did cause Stacy’s probation to be revoked. However, Stacy has still not been jailed, as she is appealing the probation revocation, and the appeal is still pending.]]></description>
