Waxhaw, About that shotgun incident

On Wednesday, April 7th, cyclists on a training ride had an encounter with a motorist.  While riding in single file on Old Waxhaw Monroe Rd, a rider pulled out to drop back, apparently impeding traffic.  A motorist driving a pick-up truck pulled along side the group and words were exchanged.  The motorist allegedly swerved close into the group causing one rider to wreck.  The motorist allegedly then cut close and tight in front of the group and slammed on the brakes causing a near wreck.  The motorist allegedly slammed on the brakes one more time before speeding off.  As the riders approached Waxhaw Elementary the man allegedly came out from a house across from the school wielding a shotgun.  The group pulled into the school and a single rider confronted the man.  The conflict ended without further incident.  Law/legal involvement is unknown.

Shots Fired from Rock Hill Cyclist

A cyclist fired 13 shots into a group outside a home in Rock Hill.  One 16 year old male was injured and taken to Piedmont Medical Center for treatment.   The cyclist got away on his bicycle.

Final UPDATE?:

The sentencing was today for the shooter, Charles Diez, who pleaded guilty to the charge of Assault with a deadly weapon with intent to kill.

The judge gave him 120 days in jail, 30 months of probation and anger management class.  This is a big victory for Diez who should have received a minimum of 15 months in jail.

Admitted into evidence was a performance review from a former fire captain that stated that “Diez complained and often escalated arguments and was quick to anger.“  That evidence might have been offset by the particularly effeminate manner in which Diez spoke in court.

Armed Robbery Ends OK

A cyclist tried to rob a motorist at an apartment complex out near the “Weave” of North Tryon.   The complex is located right behind the Shell station.   It’s unclear if the cyclist wanted to hijack the car or take other valuables/groceries.

From the Observer:

Aug. 5 3:55 a.m. Armed Robbery From Person in North Tryon Division: The victim pulled into the parking lot of his apartment at 300 W. Arrowhead Rd. and noticed a hispanic male on a bicycle riding towards him. The suspect pulled out a knife and told him to get out of the car. The victim locked his doors, and the suspect left the scene without taking any items.

Charlotte Bike Theft Up

The Chrarlotte Metro division recorded 20 cases of bicycle theft this year through September. That’s over 2 bikes per month and more than double the amount of cases than last year over the same period (9).

I heard of 2 of them.  The most famous case being the full Record flagship Prince stolen during a bike shop break-in.  Another occurred in a CATS parking lot back in August.

I always use racks provided by establishments, even when I don’t like the location, as a matter of principle.  I like to see racks in use.  However, if things get worse, I’ll have to start using my best judgement when choosing places to lock up.

By the way, the New Bern station racks and lockers are probably getting the most use in town.

Homocidal SUV Driver

Looks like a driver in Bradenton, FL has a thing for driving into cyclists/motorists.   Just when SUV drivers couldn’t get a worse reputation, one of them spends a night running down two-wheelers; one motor cycle, one bicycle.

The fine for hitting a manatee with your boat is $600.  Before the fine was instituted, many Manatees were hit by boaters and rescued.  After the fine was instituted, the same amount of manatees were hit, but then left to die.  It turns out most boaters weren’t too quick to incriminate themselves; and they ran.   Now, when it comes to hitting a cyclist, there is no penalty.  Just tell the cop [or judge] “I didn’t see him”, and your off the hook.  So why run, unless your hit-and-runs were intentional, malicious and homicidal?

Would the citizens of Charlotte show outrage over this episode? Or would these incidents be chalked-up to coincidental accidents between large, loud tire SUVs and small, dark, nuisance, dishwasher-mobiles?

Don’t Forget the Sentencing

The August Pinch Flat Award goes to ….Judge Donald Stephens

North Carolina Judge Donald Stephens earned this award for sentencing a cyclist-killing, felony-assaulter to teetotaling.

I’ve been putting a lot of thought lately into the appropriate charges for drivers hitting cyclists, but I should be just as concerned about the sentencing. In Brian Reid’s case the charges were right but the sentence was a ‘slap on the wrist’. Reid killed cyclist Nancy Leidy while driving home from class at NC State after a night of celebrating his 21st birthday. He blew a .12 on the Breathalyzer. The charges were appropriate; felony assault by motor vehicle. The sentencing last week by Judge Stephens was a joke; community service, 5 weekends in jail and teetotalism (really, he was sentenced to teetotalism).

Perhaps if you think ‘giving up drinking’ is a harsh enough penalty for such a crime…alcohol must be a pretty important thing to you.

Perhaps, just to be safe, judges with psoriasis, discoid eczema or superficial infections, common in heavy drinkers, should be barred from presiding over cases that involve alcohol – just to be safe.

How would Charlotte citizens react to ‘slap on the wrist’ sentence for a drunk student that killed a cyclist? Would they be outraged? Or would they sympathize with the student’s drunken rite-of-passage and not understand why the cyclist was in the road in the first place?

Drunk Driver Kills Cyclist near Eastland Mall

Greg Smith, 24, was charged with Driving While Impaired and No Operator’s License after hitting a killing a bicyclist on Central Avenue near the Eastland Mall, in East Charlotte. The crash occurred around 2 AM Saturday morning. Smith’s passenger and next door neighbor, also 24, was charged with Aiding and Abetting Driving While Impaired.

The 44 year-old cyclist, whose name was not released, died at the scene.

I always thought that the reason the penalties for drunk driving were so severe was to keep drunk drivers from killing people (the real crime). However, in this case, the charges from the CMPD don’t reflect the real crime.  I hope the district attorney charges Smith with vehicular manslaughter?

It seems open and shut to me, but would a ChARLOTte (Car – Lot) jury convict an unlicensed, impaired man for slaughtering a cyclist crossing the road near the Eastland Mall at 2am?   Perhaps the ChARLOTte jury would sympathize with the driver and his abetter…and not comprehend why a cyclist was in the road?

If accident fault is not automatically given to drunk drivers, then why is drunk driving a crime?

The victim’s family has my most sincere condolences.

Doctor Road Rage

Update:

Nov. 2, 2009 Thompson was found guilty of six felonies and one misdemeanor.  He could face as much as five years in prison.

He was handcuffed in the courtroom after the verdict was read.  Thompson was accused of assault with a deadly weapon, reckless driving causing specified bodily injury, battery with serious bodily injury and mayhem.

I know this is outside of my jurisdiction, but…

Dr. Chistopher Thompson of Los Angeles was charged with two counts of felony reckless driving for allegedly pulling in front of cyclists Ron Peterson and Christian Stoehr, then slamming on his brakes causing the cyclists to crash.

Patrick Watson filed a police report earlier this year against Dr. Thompson alleging the exact same senario on the exact same road.

I believe that Dr Thompson is a psychotic homicidal loser. I hope he gets 7 years in jail.

Perhaps a California jury will convict him. What would a Charlotte jury do? Perhaps a Charlotte jury would sympathize with the driver. I can easily imagine a cross examination of Charlotte cyclists focusing on why they were in the road.

Hodge Podge -1

A CATS rider that identifies him/herself as Hodge Podge is minus one bicycle. Thieves made off with the bike while parked in a Charlotte parking lot for eight hours. This totally disturbs me. I understand but hate the fact that as long as I continue to lock and leave my bike, I’ll eventually have ANOTHER bike stolen. There are bike thieves operating in Charlotte. We should all anticipate more stolen bikes as people seek alternatives to high gas prices and the demand for bikes goes up.

I hope Hodge Podge can get another bike and use it to commute.
