Frank Depasquale, Get Well Soon
July 16, 2010. Frank Depasquale was involved in a bicycle- car collision on Providence road Thursday at 6:40 pm. Frank has scrapes and bruises and is getting checked out. As Frank waited on the median to finish a left turn onto Providence Rd., he was struck by a driver making the same left. The driver, from Ballantyne, told Officer Barba that she “didn’t see the cyclist.” She was not issued a citation.
Frank is a regular on the Donald Haack team rides. I wish him a speedy and full recovery and hope to see him back on the road soon.

So, why wasn’t vehicle #1 driver issued a citation? Am I missing something? At what point is someone issued a citation — when they’re drunk?

It would be helpful to have some clarification on why the driver wasn’t cited. Sounds like she ran directly into Frank and basically rear ended him. Frank, glad you are doing ok.

I’m not a lawyer. It’s my understanding and experience that is is not against the law to crash. If a Charlotte cop does not witness the accident, they won’t write ‘failure to reduce speed’, reckless’ or ‘careless driving’. Since this blog started CMPD has written ‘DWI’, ‘missing baby/car seat’, and ‘class IV drug possession’; also ‘leaving the scene of an accident’. The district attorney might charge the driver after the facts are in.
Even when the cops witness a collision, they still might not write the ticket…i.e., when Gibbons was hit, cops were present on golf tourney parking duty and didn’t write a ticket.

Thanks for the info. I erroniously thought that some kind of implication of guilt might bring about a citation. So then the proper course is for the injured party to file for damages and have the officer subpeonaed? And then afterward, a judge might consider the driving ability of the offender?
